01 general terms

1.1 Thank you for using isabellabainbridgedesign.com (the 'site'). These terms and conditions govern your use of the site, and purchase of goods, and services from the site. If you have any questions, please contact us by using the ‘Message Me' form from our enquiry menu. In these terms and conditions, "we", "us", "our" means isabellabainbridgedesign.com.

1.2 Please read these terms and conditions carefully before using the site. By accessing the site and/or placing an order/ and or booking a service, you signify your agreement to be bound by these conditions and you consent to us using your information in accordance with our privacy policy . If you do not accept these terms, do not use the site.

1.3 You must be 18 years of age or older to purchase goods and/or services from the site. If you are under 18, you may use the site only with the involvement of a parent or guardian. Your use of and registration on the site is void where prohibited.

2.1 isabellabainbridgedesign.com has as its priority your total satisfaction with our products and services. In the unlikely event that you are unhappy with your purchase/and or services, please notify using our ‘Message Me’ form from our enquiry menu.

2.2 Should you wish to return an item you have a legal obligation to take reasonable care of the goods when they are in your possession. We have a strong Quality control process for goods in and out including full outbound product inspections.

03 delivery

3.1 Please see our ‘Delivery Charges’ page for information on delivery times and costs.​

3.2 We will use our reasonable endeavours to deliver the goods or services in the UK within the times indicated. However, where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control.

3.3 We shall attempt to deliver the goods to the billing address you specify for delivery. You are responsible for making arrangements to receive the goods, should you not be available to take delivery, and if the goods are held at the delivery company's depot, it is your responsibility to collect the goods within the timeframe defined by the delivery company. It is important that the address supplied by you to us is accurate.

5.1 The isabellabainbridgedesign.com site uses the secure PCI compliant Wix Payment service powered by Wix. Wix is Payment Card Industry Data Security Standards (PCI DSS) compliant and is accredited as a Level 1 service provider and merchant. Wix’s PCI DSS compliance is assessed by an external company, and we are audited on a yearly basis in order to align with PCI standards.

 

This is the most stringent level of certification available in the payments industry. This means your card details are not entered or stored in the isabellabainbridgedesign.com site, but entered directly into the secure Payment Services website.

06 Contract for Sale or Services

6.1 The advertising of products and services on this site is an 'invitation to treat'. That means your order is an offer, and no contract of sale is formed between you and isabellabainbridgedesign.com until you receive a 'confirmation of order' email.

6.2 Orders shall be accepted at our sole discretion, and are normally accepted at the point payment is confirmed to isabellabainbridgedesign.com by the Payment Service Provider. Acceptance of your order by Isabella Bainbridge Design means we shall charge your account for payment, and you shall pay the price for the goods or services, VAT, delivery and other costs specified on the order page.

6.3 The description of the goods, services, price, currency, VAT and delivery costs are set out on the order page or proposal schedule . In exceptional circumstances, if we are not able to fulfil an order we have accepted, your credit/debit card will be refunded with the original price, and we will notify you by email. In no circumstances will we be liable to you for any additional amounts.  For service proposals, additional T&C’s will be contained within your proposal and contract.

6.4 These terms and conditions cannot be varied except by changes made by isabellabainbridgedesign.com on the site, or within the terms and conditions of your service proposal and contract, which we may make from time to time. By using our site you are agreeing to these terms and conditions. You will only own the goods you purchase once they have been successfully delivered and when we have received cleared payment for them in full. Until that time we will retain title to the goods. Goods supplied are not for resale.​​

07 Cancellation and Exchanges

7.1 If you wish to cancel your order for whatever reason, and your order has not yet been dispatched, please contact us using the ‘Message Me’ enquiry form. Once we have processed the cancelled order we will arrange for a refund. Should we have dispatched your order please refer to our ‘Returns Policy’, and follow the instructions.

For services your individual proposal and contract contain specific cancellation and rescheduling terms.

08 Defective or Damaged Items

8.1 Should you receive an item you have ordered that is defective or damaged please follow our ‘Return Policy’ on how to return the item to us.

09  Customer Queries

9.1 If you have a query please contact us using the ‘Contact Us’ form and we will endeavour to respond within two working days.

9.2 All orders must be placed via the isabellabainbridgedesign.com web site, we do not accept orders via email or telephone, as we cannot guarantee any secure transmission of details. We will take all reasonable care to keep your order secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data (including credit and account details) you provide when accessing or ordering from the site.

10 Disclaimer and Liability

10.1 We reserve the right to change, modify, substitute or remove without notice any information on the site from time to time. We will endeavour to ensure that all descriptions and illustrations of the items on the site or in our catalogue or otherwise provided to you by us are accurate but there may be slight variations due to print and publishing limitations. Isabella Bainbridge Design Limited will work to keep the site up to date but cannot guarantee that this site and its contents are completely free of technical errors, viruses or anything else that may have a harmful effect on any technology. We will endeavour to allow uninterrupted access to the site but access may be suspended, restricted or terminated at any time.

10.2 In no event shall we be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with the terms and conditions or use of the site save where such liability cannot be excluded by law.

10.3 You must use the site for lawful purposes only. If we allow you to register with us you are fully responsible and liable for all access made to the site using any password or user name that you register with us. You should keep such passwords and user names confidential at all times.

10.4 If you are not satisfied with the site, then please email us with your comments.

10.5 If you have a valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods, we shall be entitled to replace the goods (or the faulty part in question) free of charge or, at our sole discretion, refund to you the price of the goods (or a proportionate part of the price).

10.6 If you have a valid claim based on the quality of any repairs we make to your goods, then we shall be entitled to rectify the defect free of charge or, at our sole discretion refund to you the price for the repair of the goods. We are not responsible for damage to items before the product was in our.

10.7 These terms and conditions do not affect your statutory rights (if appropriate) as a consumer.

10.8 We shall not be liable to you or in breach of these terms and conditions for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control.

10.9 In the case of repairs we strongly advise that you maintain adequate insurance for your product while it is in our possession.

11 Disclaimer and Liability

11.1 Customers are legally entitled to cancel an order within 7 working days of receipt of the product. Please see ‘Cancellation’ section for goods that have not yet been dispatched by us. For goods that have been dispatched by use please follow our ‘Returns Policy’.

12 Customer responsibility

12.1 This site and its contents will not constitute the basis for any contractual commitment between Isabella Bainbridge Design Limited and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of products Isabella Bainbridge Design Limited would contravene any applicable local, regional or national legislation. No prospective customer should seek to make any order through the site from jurisdictions in which it would be illegal for Isabella Bainbridge Design Limited to sell products.

13 Customer responsibility

13.1 Your use of this site and any contract between you and Isabella Bainbridge Design Limited for the sale of products shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales. 14.1 All Isabella Bainbridge Design Limited constructed materials, including images, illustrations, designs, site layout, photographs, written and other text or script that are part of this site together with all software compilations, underlying source code and software in the site are protected by copyright, trade mark, design right, and/or other worldwide intellectual property rights and are owned or controlled by or licensed to Isabella Bainbridge Design Limited. Isabella Bainbridge Design Limited does have the right to sell designs and artefacts belonging to other design companies, these items are protected under their own copyrights. All rights are reserved.

As a result, all Wix online stores are automatically PCI compliant, and fully secure which ensures our customers have peace of mind when shopping online and makes sure the business comes across as legitimate and safe.

 

Wix.com Ltd. is based in Israel, which is considered by the European Commission to have an adequate level of protection for the personal information of EU individuals. 

 

Wix.com Ltd.  also have many group companies and third-party processors worldwide so they may process personal information in other countries if necessary. Their main processing and data storage locations  are in the United States of America, Ireland, Japan and Israel and they have implemented controls and processes in line with GDPR.

05 WHO ELSE MAY WE SHARE YOUR DATA WITH?

Isabella Bainbridge Design will provide your data to third parties in order to enable services for payment providers, delivery couriers, complaints, Website operations, Law enforcement. 

 

Isabella Bainbridge Design will retain a list of the third parties with whom data is shared, which is available on request.

We will store your data for as long as strictly necessary for us to provide the relevant services to you, for as long as you wish to stay in touch with us or as long as is necessary to provide support related reporting and analysis. Even if you request to erase your data we may keep it in a form that does not identify you for legal and regulatory reasons, the resolution of disputes or to enforce our terms and conditions. If you have not agreed that we may use your data for Marketing purposes, we will keep your data for 6 years after you have made a purchase.
